Go to your closest US military legal office and file a formal complaint it will be investigated and resolved. Explain to the SP's/MP's the reason you are there and someone from the legal office should sponsor you on base if needed.  If a crime was committed while on Active Duty that individual can be held accountable even after they separate. Normally they are still under UCMJ for a few reserve years and if they are retired they fall under it for life. Time is critical, file the complaint today.

Don't loan money to anyone without collateral if you expect to get it back, it saves the hassle of pursuing them through the courts and legal system.

I agree.  This guy is just going to continue dragging his feet, and you'll be an old lady before you ever see your money again.  It's time to take this up with the court system.  He's just going to continue making excuses.  You'll never see your money if you continue to let him control the situation.  You have to play hardball.  Don't let him keep playing you.  He may be unemployed now (or, he may in fact be employed and telling you otherwise)....but, whatever the case may be, if you take it up with the legal system, you can have them start garnishing his wages as soon as he has gainful employment.  Don't let him decide when he's going to pay you and how much.  Take your power back and "make" him pay what you are owed.  It's time to stop playing games with this deadbeat. 

Do you have someone that can escort you on the base so you can visit the legal office?

I would do something to make that card not usable if you can. He could always retaliate and hand it over to someone or keep using it ti rack up the bill. This guy is very rash when he makes decisions and doesnt think them through.

Using the only way he can now to hurt her looks pretty good even if it hurts him in the long run. I would also bet you he wouldnt see it as hurting himself in the long run. So I say before going all out, take steps to protect yourself as much as you can.This is not a nice or smart man and he is nothing but trouble.

As far as the credit card is concerned simply call up the bank or issuer and have it cancelled or report it as stolen. They will issue another and mail it to you. That is the simplest problem you have all it takes is one phone call.

By now you should have contacted the military law enforcement authorities and filed a formal complaint of any wrong doings, do not wait. Make sure you bring any evidence that you have with you, emails can be used as evidence as well.

The burden is on you to provide the evidence, it sounds like through emails alone you may be able to prove your case if you don't have a promissory note or something similar.

I didn't read each post here but, if this is a person that you have had relations with then possibly you also have ways to contact his relatives too.  I would explore all options and contact them as well which could be a method of applying additional pressure towards someone who failed to keep their end of an agreement, and mention that you have filed a formal complaint with US military against him.  Theft is a crime, 10K sounds like grand theft to me which carries stiff penalties if convicted.  It may also involve international theft too.

I am assuming this "loan" took place in Japan, so the US military would be the first stop because he was stationed in Japan at the time, followed up through the Japanese courts.  I don't know how much jurisdiction the Japanese courts would have but the military can still reach out and touch him.

I was watching Susan Ormand one night and she suggested anyone that wanted to borrow money from you, like a large amount, ask that you can take a life insurance policy out on them. I betcha that will make them ask someone else for the money! I hate money, esp with friends. I dont loan what I cant afford to lose. I could never even leoan $10,000 to familymember, nonetheless a stranger! Poor girl...

I found the U.S. military wouldn't help me because he already left. One guy who checked this forums kindlly told me he is in Utsunomiya (Northern Kanto city). But to sue him, I need his address in Japan.
I didn't get any response from him right now. Now I'm talking with a laywer and also Japanese police.
I won't give up my money and I won't forgive him. I want him to get in Japanese jail someday.

I've got my creditcard from Lodge last week. But he starts ignoring me again. But I found his address, I will visit
Utsunomiya and will wait in front of his room, or I will visit his girl friend who is an owner of the sports shop in the town. I can recognize her face. One I found him, I will call police and talk with him and a policeman together.

S/L was on Yokosuka base a few weeks ago. he is attending college classes on base he got picked up coming through the main gate by security because his old command forgot to lift an arrest order from before he got put out of the navy.

Sounds like a real savory guy. How does he get on base? He must either be SOFA status, have a reserve ID card, or was escorted. If he has a reserve card, he is not beyond the reach of base legal. Maybe even likewise for SOFA status. Koruru was once told by legal that there was nothing they can do because he was no longer in the Navy but maybe that's not as true as they made it sound.

i do not remember the exact reason he was able to get back on base. he is not in the reserve and not in a sofa status. he lost his clearance and 2 paygrades, then was given the boot for hyt. if i had seen this thread before he was caught on base, i would have had security contact NCIS.

i am not so sure Security knew... after all they did not know that he was out of the navy and they refered to him as a 2nd class. he had been out of the navy for months at that point.

Good luck, Kuroru. Hopefully things will work out in your favor. In America, we gotta have "proof" of payment. So, w/out a receipt, email stating that a payment was made, or some other proof of payment, he would be out of luck. He wouldn't be allowed to just say, "I paid her!"

Congratulations on your day in court! That was a long, hard road. So he'll say "I paid!" And his gf will say "I saw him pay!" Two witnesses? Hopefully the gf will not get to say anything; she should not be considered a reliable or relevant witness. But I don't know how Japanese courts work. Are you getting any legal advice?

and the document is it in the U.S. He still tells a lie even in court. If he forged the document, it will be a real crime and be sent to jail.

Kuroru says "counsel for the defense" told her to delete the posts.  In other words, the scumbag's lawyer said it.  I would say that's total bunk; why would you do it just because the other guy's lawyer tells you to?  Sounds to me like HE doesn't want it online, which is another good reason to leave it up.

Since you're already in court, just wait until the judge tells you to take it down.  Until then, up it stays!  Furthermore, you can quite honestly tell them you're not able to take it down (there is no more edit button.)  So it is impossible for you to comply.  The website owner has no responsibility to do so unless there is a court order.  Tell that dirtbag you will relay the request to the JB site owner if & when there is a court order.  My guess is the last thing they wanna do is draw the judge's attention to this website.  As I recall, there are promises from Mr. Douche dating back to last May saying he will pay you, yet he hasn't paid. That's probably what the lawyer wants removed.  Leave it up!

I believe under Japanese law it is illegal, I know of someone in a similar situation (we'll no one loaned anyone 10 grand but it involved money and notes in a public place demanding the repayment)

I would suspect they already have a copy of it as evidence on both sides of the case.

Thai would be correct as to the defense attorney would be in no position to make such demands. It would be presented to the judge and then any decision would be passed along through your attorney.

What was your attorney's response?

Hmm....you guys must never of heard of "2 Channel". Where anyone can post anything anonymously without fear of retribution and that site is located here in Japan. "2 Channel" has had MANY court orders demanding that they delete slanderous threads, and the owner has not done so. Moreover, if it is not "kuroru" who is putting the name into these posts, how can she be made accountable for another persons actions?

Finally, some of you may recall when the earlier thread where she had mentioned him by name, and posted his pic, and Adam removed that thread presumably because he was mentioned by name. imho.
