In a serious national security case like this the branch of service (in this case I presume the Army) can request that Department of Justice take over the case. I'm not sure about all the details, but I wouldn't be surprised if that happened. I also wouldn't be surprised if the lenient military justice system lets him off with a pretrial agreement and a light sentence. I hope I'm wrong, but I spent too many years working with Navy Jags and know the system inside and out.

Seeing as how Lamo approached the Feds (and I wonder how much money he asked for hmm...) it's likely in their ballpark already.

There's going to be a lot more said about moral duty vs. legal and military duty, et al. And I'm not even going there.

But in my opinion the _real_ criminal in this case was the information systems security officer.

I'll be amazed if this guys gets anything less than a one-way ticket to Kansas to smash big rocks into little rocks. This is like the "John Walker" of this era, and I wouldn't mind seeing this idiot being used as the example of what NOT to do.
